Terms of Service

The rules for using tchproviders.com and TCH products.

Agreement

These Terms of Service ("Terms") are an agreement between you and TCH LLC ("TCH", "we", "us") and apply to our website at tchproviders.com and to TCH Carrier Finder, TCH DAT Extension and TCH Browser (together, the "Services"). By creating an account, installing or using the Services, you agree to these Terms. If you use the Services for a company, you agree to them on that company's behalf and confirm you have authority to do so.

Accounts

  • Some Services require an account. Accounts may be created by TCH or by your team's administrator.
  • Give accurate information and keep it up to date.
  • Keep your password private. You are responsible for everything done with your account. Tell us right away if you think it has been misused.
  • Accounts are personal. Don't share your login or resell access unless we agree in writing.
  • Some Services check the device your account is used on, to keep accounts secure.

Acceptable use

You agree not to:

  • Break any law, including laws on unsolicited email, telemarketing, calling and text messaging (such as the CAN-SPAM Act and the Telephone Consumer Protection Act) and privacy laws.
  • Ignore opt-out requests. When a carrier, broker or anyone else asks you to stop contacting them, you must stop.
  • Send spam, misleading messages, or messages that impersonate someone else.
  • Copy, scrape, resell or publish our data or Services in bulk, or use them to build a competing product.
  • Reverse engineer, decompile or try to get around security, limits or device checks, except where the law allows it.
  • Use the Services to break the terms of other websites or platforms you use, such as load boards or email providers.
  • Use TCH Browser or its connections for fraud, unauthorized access to accounts or systems, or any other illegal activity.
  • Upload malware or interfere with the Services or other users.

Carrier data and accuracy

Carrier information in TCH Carrier Finder comes from public US Department of Transportation records and is refreshed regularly. Public records can be incomplete, delayed or wrong, and some values (such as estimated insurance expiry dates) are calculated estimates. The data is provided "as is" for business research and outreach. Check important details directly with the carrier or official records before relying on them, for example before booking a load or binding insurance.

Third-party services

The Services work with services run by others, such as Google (Gmail and Maps), DAT One, email providers, GitHub and Google Drive. Your use of those services is governed by their own terms. We are not responsible for them, and changes they make may affect how our Services work.

TCH DAT Extension is an independent product. It is not affiliated with, endorsed by or sponsored by DAT Solutions. DAT and DAT One are trademarks of their owner.

Plans, trials and limits

  • Some Services are offered as free trials and paid plans. The price and length of a plan are those we tell you when you subscribe.
  • Paid plans renew for the same period unless cancelled before the renewal date.
  • Services may have usage limits, such as monthly export and email limits, shown in the product. We may change limits with notice.
  • When a trial or plan ends, paid features may pause until it is renewed. Your saved settings stay in place for a reasonable time.
  • Fees are non-refundable except where required by law or agreed by us in writing.

Your content

You keep ownership of what you put into the Services, such as templates, notes and settings. You give us permission to store and process it only as needed to provide and support the Services for you. You are responsible for the content of the emails and messages you send using the Services.

Our property

The Services, including software, design, text, logos and the way we organize data, belong to TCH and its licensors and are protected by law. We give you a limited, non-exclusive, non-transferable right to use the Services under these Terms while your account or plan is active. If you send us feedback, we may use it without any obligation to you.

Privacy

Our Privacy Policy explains how we collect and use information, including Google user data. It is part of these Terms.

Suspension and termination

You can stop using the Services at any time and ask us to close your account. We may suspend or close an account that breaks these Terms, puts other users or the Services at risk, or has an unpaid plan. Where reasonable, we will tell you first. Sections that by their nature should continue (such as data accuracy, disclaimers, limits of liability and indemnity) continue after termination.

Disclaimers

The Services are provided "as is" and "as available". To the fullest extent allowed by law, TCH disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Services will be uninterrupted, error-free or that any search, email or connection will produce a particular business result.

Limitation of liability

To the fullest extent allowed by law, TCH will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from or related to the Services. TCH's total liability for any claim related to the Services is limited to the greater of the amount you paid TCH for the Services in the 12 months before the claim, or 100 US dollars.

Indemnity

You agree to defend and hold harmless TCH and its owners, employees and partners from claims, damages and costs (including reasonable legal fees) arising from your use of the Services, your content or messages, or your breach of these Terms or the law.

Governing law

These Terms are governed by the laws of the State in which TCH LLC is organized and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in that State, unless the law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the date at the top. If a change is material, we will tell you by email or in the product before it takes effect. Continuing to use the Services after the change means you accept the new Terms.
